却下決定が誤りだと思うときは、審査請求で争うことができますし、審査請求と同時並行で再度申請することができます。最初の時点で資産オーバーでも、再申請の時点で所持金が減っていれば保護が決定されます。審査請求については、弁護士等の専門家に相談するのがよいです。

さらに言えば申請は要件を満たさなくても出来ます。申請の後、福祉事務所が要件を満たすか審査し、満たしていれば保護の決定が出ますし、満たしてければ却下されます。明らかに要件を欠くのに申請することは福祉事務所に負担となるので避けるべきですが、迷うレベルの時は申請してもよいと思います。

私も生活保護申請に同行に行く時に支援団体に「所持金3万を切らないと申請できないからそれ以上持ってたら3万切ってから行って方が良い」と助言もらってマジあり得ないと思いつつ本当にそうなのかと思ってた。法律を知らないと権利を行使できないなんて本当にしんどいわ。

逆に言うとスッカラカンになってから申請してもすぐに保護費は支給されず決定が出るまで窮地に陥ることが多いです。もちろんその間も社協の貸し付けやフードバンク等でしのげますから絶望する必要はありませんが所持金10万円を切り近々入ってくる予定がなければ申請をリアルに検討して欲しいです。

これは、ウソです。所持金が１ヶ月の最低生活費の半分を切っていれば、即座に申請すべきです。その根拠は、生活保護法２４条５項本文は原則として申請から１４日以内に保護の要否を決するとしており、審査中にその所持金が尽きると考えられるからです。スッカラカンになるまで待つべきではありません。 twitter.com/kikko_no_blog/...
