だから、この事件は逮捕の中止（令状の不執行）が適当だったのかどうかから審査すべき問題である。
これが適当だったとすれば、逮捕状の請求上の瑕疵か逮捕状発行の瑕疵が問われる事になる。警察と裁判所、どちらも面子に関わる事だから、瑕疵を認めたがらないだろう。

そもそも起訴されなかったのだから、裁判所の方でも判断の下し様がないのである。それを検察審査会が不起訴としたのだから無実だと主張するのは、山口側の情報操作である。裁判所と検察審査会は全く違う意味の組織であり、審査会の方は充分な独立性は保たれていない。
