任命に関する解釈変更は日本学術会議の独立性に関わるものだけに、法律の主旨を変えるという意味で、『実質的な法改正』です。そのような大事が闇で行われ、周知もされなかった。
この件だけではなく、他の法律でもこっそりやってそうな気がします。

学術会議を政府組織ではなく独立した非営利団体にすべきという議論も、アジア諸国では政府組織のことが多く欧米で非営利団体が多いということからすると、結局の民間に金を持っていて公共に寄付をするようなハイソな社会階層が育っているかという国情に左右されるということである。

条文上は問題ありませんが、制定時の国会答弁があるので解釈の変更をする必要があります。
解釈変更に議決は必要ないので内部決裁もしくは閣議決定があれば問題はなくなりますがそこは明確になっていません。
これがなされていない場合、司法判断は「違法」になる可能性あり。
